Thank you for choosing to work with Certified Fireplace and Chimney!

With the deposit, we will order the parts necessary for the listed repairs. Thank you for understanding our policy on deposits. Because of the unique nature of chimneys and the parts they need, we can not issue refunds on deposits. A deposit is taken, so we can order the special issue parts you’ve requested. The deposit likely does not cover the price of the parts in entirety. Also, because we’ve scheduled a time for your repair, we can not readily give that spot to someone else on short notice, and a cancellation would put several people in a spot of not having a repair to do on the date that your work was scheduled. So, understandably a refund can not be given because regardless of work to be had, we have given our commitment as a company to make sure our team has a career that will make sure they are accounted for. Exceptions can be made on a case by case basis, but only at the owner’s discretion and ALWAYS in writing. Please let us know if there are any questions you have on this. By signing this form, you agree to pay for the work in full regardless of your opinion of its completeness, and agree to our terms and policies at our company.

When repairs or modifications to your chimney are chosen to be completed by us that can be readily seen or otherwise, (i.e. brick replacement, rebuilding, tuck pointing, gas/wood insert, etc.), we will do our best to find the best match that’s locally available. We have your best interest in mind, and we ONLY want you to be happy for have chosen Certified Fireplace and Chimney to complete your repairs. In the event the work we do does not meet the exact match often held in our mind’s eye, we can not issue a refund and will still need to be paid in full. By signing this, you agree to let Certified Fireplace and Chimney do their best in choosing materials for you that are the best fit for, and you will not hold us accountable for the end result. Certified Fireplace and Chimney reserves the right to make changes at any time, without notice, in design, material, specifications and prices and the right to discontinue styles and products.

In the event we discover that upon opening up otherwise inaccessible areas of the chimney or fireplace, there are issues at hand, we will be sure to let you know. Often times, this is met with disregard by the homeowner. We ask that you understand it is in your best interest that we bring additional issues to light, as we do not want you to have the false since of security when it comes to your home. You do have the choice for us to remedy the situation, at likely an additional expense, or have us simply note it, and have you sign that we told you, and you were aware of the additional items.

Our repairs are listed in this agreement to the extent they will be done. If there are additional items you understand to be done that are Not listed, we have to insist that you make us aware of these items, so we can add them to the line items of work we will provide to you. We do this to gain your satisfaction at the end of the job – that what you understand to be done, will be done, and we have record to show that we did those items for you.

We take pride in our ability to keep your home protected while we work. Even during massive repairs that turn your home into a construction site, we go to great lengths to protect your home, so that it may remain habitable during our work. You can expect to have dust in areas we are working; however, know that we are diligent in protecting the work areas, and control that dust as much as possible. Frequently traveled walk areas from our trucks to the work site may be worn some from our frequent trips to and from. We wouldn’t be around if we made a habit of dirtying or harming peoples homes. We ask for your understanding in this and want you to know that you’ve hired the best when it comes to home care and repair.

In the event that this bid is submitted to insurance, and your home insurance approves this bid for repair, you must use our services for the authorized work. If you decide not to, you will be responsible for our time, effort, and the use of our name to get the claim approved. The financial obligation in that case will not be less than the maximum amount allowed in small claims court.

These terms can be updated and changed at any time by Certified Fireplace and Chimney, without notification.

By executing this Work Order through my signature below, I hereby acknowledge, affirm, and agree that my signature functions as both (i) an express authorization and confirmation of the work to be performed as outlined herein and (ii) an unequivocal acceptance of the confidentiality, non-disparagement, and non-disclosure obligations as set forth in this provision. I further acknowledge that as a condition precedent to engaging in any form of business, professional, contractual, or service-related interaction with CFAC (hereinafter referred to as the “Company”), whether directly or indirectly, I am bound by strict confidentiality covenants that extend to, but are not limited to, all aspects of my experience, interactions, communications, and/or engagement with the Company.

In furtherance of these obligations, I expressly covenant and agree that under no circumstances shall I, at any time, whether during or subsequent to the completion of services, in perpetuity, unless expressly authorized in a written instrument executed by an authorized representative of the Company, disseminate, disclose, discuss, transmit, publish, post, reproduce, or otherwise communicate, in any capacity, manner, or medium—including but not limited to oral, written, digital, electronic, broadcast, social media, or any other form of tangible or intangible communication—any and all information, details, representations, impressions, opinions, or statements, whether factual or subjective, concerning the Company, its personnel, business practices, internal operations, contractual agreements, methodologies, policies, or any other matters pertaining to or involving the Company.

I acknowledge and stipulate that this confidentiality obligation extends to any direct or indirect statements that could be reasonably construed as referencing or relating to the Company, regardless of whether such statements are explicitly or implicitly made, and irrespective of whether such disclosures are made knowingly, negligently, or inadvertently. I further agree that any breach, violation, or non-compliance with this provision, whether intentional or otherwise, shall constitute a material breach of this agreement, thereby subjecting me to any and all available legal and equitable remedies, including but not limited to injunctive relief, monetary damages, and any other compensatory, punitive, or consequential remedies as permitted by law.

Additionally, I expressly acknowledge and agree that in the event of any violation of this provision, I shall bear full, sole, and absolute responsibility for any and all legal consequences arising therefrom, including, without limitation, any and all attorneys’ fees, court costs, damages, or other expenditures incurred by the Company in the enforcement of this provision or in the pursuit of any remedial action related to a breach. I further waive any and all defenses, claims, or objections related to the enforceability of this provision, understanding that it constitutes a material and bargained-for term of my engagement with the Company.

By signing below, I affirm that I have carefully read, fully understood, and voluntarily agreed to the foregoing terms and conditions in their entirety, and I acknowledge that I have been afforded the opportunity to seek independent legal counsel regarding the same prior to execution.

This is a legally binding agreement. Only sign this agreement if you understand the terms and agree to the conditions. These terms and conditions are accessible by the link provided on the quote from Certified Fireplace and Chimney. Final payment, or balance due, is due at the completion of the work as Certified Fireplace and Chimney describes. If an exception is made, this would need to be listed in the work order.
